1. INTRODUCTION AND ACCEPTANCE These Terms and Conditions ("Terms") set out the conditions under which Everest Group Ltd ("Everest Group", "we", "us", or "our") provides you access to our services, including giveaways and automotive services, and governs your use of our website located at https://everestgroup.ltd(the "Site"), and the information, content, features and services provided through the Site (collectively, the "Service").
YOUR USE OF THE SITE AND/OR THE SERVICE, OR THE PURCHASE OF ANY MEMBERSHIP OR ENTRY PACKAGE, SIGNIFIES YOUR AGREEMENT TO THESE TERMS AND CONSTITUTES YOUR BINDING ACCEPTANCE OF THEM, INCLUDING ANY MODIFICATIONS THAT EVEREST GROUP MAY MAKE FROM TIME TO TIME.
If you do not agree to these Terms, you must not access or use our Site or Services.
Everest Group may amend these Terms at any time by posting the amended Terms on the Site, and you agree that you will be bound by any changes. Everest Group may make changes to the Site and/or the Service at any time. You understand that Everest Group may discontinue or restrict your use of the Site and/or the Service for any reason or no reason with or without notice.
2. WHO WE ARE Everest Group Ltd operates two core business divisions:
· Everest Giveaways: A promotional platform offering prize-based giveaways (currently featuring the MG ZS Vibe), targeting the Nepalese Australian community.
· Everest Performance: An automotive service provider based in Sydney offering diagnostics, detailing, servicing, upgrades, and car content promotion.
3. PRIVACY POLICY By purchasing a membership, using our platform, or entering one of our giveaways, you represent that you have read and consent to our Privacy Policy in addition to these Terms. Our Privacy Policy outlines how we collect, use, and protect your personal information. Everest Group may revise the Privacy Policy at any time, and new versions will be posted on the Site. If at any point you do not agree to any portion of the Privacy Policy, you must immediately stop using the Site and/or the Service.
4. ELIGIBILITY To use our Services and participate in giveaways, you must:
a) Be 18 years of age or older.
b) Be a resident of Australia;
c) Not be an employee, contractor, or immediate family member of Everest Group Ltd or any person residing in the same household as an Everest Group employee, director, or manager.
5. ACCOUNT REGISTRATION AND SECURITY
5.1 Account Creation To use certain portions of the Site and Service, you will be directed to register and create a user profile or account ("Account"). You may be asked to submit your name, address, email, and select a password.
5.2 Accurate Information You agree all information you provide for account creation is true, accurate, current, and complete. You agree to:
a) Promptly update your Registration Information;
b) Maintain the confidentiality of your password.
5.3 Account Restrictions You may not:
a) Impersonate another person;
b) Use a profane or inappropriate username;
c) Allow others to use your Account.
5.4 Account Security You must immediately notify us at everestgroupltd6@gmail.com of any unauthorized use. You are responsible for all activities under your Account.
6. PARTICIPATION IN GIVEAWAYS
6.1 Entry Methods
Giveaway entries are provided only as bonus promotional benefits accompanying the purchase of Everest Group Ltd memberships, services, or products at their normal retail value.
No separate purchase of entries is available, and no direct entry fee is charged. This complies with NSW Community Gaming Regulation 2020.
All entries are promotional and not refundable, except where required by law. Use of bots, scripts, or automated systems to enter giveaways is strictly prohibited and will result in disqualification.
6.2 No Guarantee of Winning
Entries do not guarantee winnings. Prizes are awarded through a certified random selection method overseen by an independent third party. All giveaways are games of chance and do not require any skill or judgment to win.
6.3 Trade Promotion Permit
Our giveaways are conducted under NSW Fair Trading Trade Promotion Permit No: TP/03932. Everest Group Ltd complies with all relevant trade promotion laws.
6.4 Draw Process & Terms Accessibility
Draw details, including date, time, and method, will be announced for each giveaway. Winners will be notified via their registered contact details and published on our website and social media.
These Terms and Conditions are publicly available free of charge on our website, social media, and checkout page prior to any purchase.
6.5 Prize Delivery and Unclaimed Prizes
Winners must accept prizes within 3 months of notification. If a prize remains unclaimed after this period, a redraw will occur under the same conditions as the original draw.
Prizes are non-transferable and cannot be exchanged for cash. Delivery will occur within 30 days of acceptance.
Winners are responsible for any additional costs not explicitly included. Prize winners may be required to provide government-issued identification and proof of address prior to prize collection to comply with legal and regulatory obligations.
6.5a Prize Substitution Clause
If the advertised prize becomes unavailable due to circumstances beyond Everest Group Ltd’s control, a prize of equal or greater value will be substituted.
6.6 Promotional Structure Disclosure
Giveaways and draws are operated as trade promotions under Australian Consumer and Trade Practices law.
The value of memberships is derived from a combination of exclusive content, partner discounts, brand access, and community engagement.
Entries are provided as bonus promotional benefits and are not sold separately.
6.7 Marketing Disclaimer
Campaign durations, entry bonuses, and closing periods may vary or be adjusted at our discretion. All promotions are conducted in good faith and in accordance with fair-trading standards.
All countdowns, urgency messaging, or scarcity references in our advertising are for promotional purposes only and do not necessarily reflect real-time ticket availability unless explicitly stated.
6.8 Referral Abuse Policy
We reserve the right to audit all referral activity and revoke entries or benefits earned through suspected abuse, self-referral, account duplication, or other deceptive practices. Violations may result in disqualification and account termination.
6.9 Record Keeping
Everest Group Ltd maintains detailed records of all entries, transactions, and draw procedures for a minimum of three years, in compliance with NSW Fair Trading requirements.
6.10 Product Usefulness Disclaimer
All products or services bundled with memberships are provided as-is, and Everest Group Ltd makes no warranties regarding merchantability, usefulness, or compatibility beyond Australian Consumer Law requirements.
6.11 Affiliate Responsibility
Affiliates, influencers, or referrers are not authorized to represent Everest Group Ltd in any legal or promotional capacity unless expressly approved.
Misleading or exaggerated claims by third parties do not reflect Everest Group Ltd’s official policy.
7. MEMBERSHIP AND PACKAGES
7.1 Membership Types Membership tiers provide varied benefits including entries, discounts, and offers. Details are available on our website.
7.2 Entry Accumulation Members accrue entries based on membership tier and tenure. VIP members may receive bonus entries at specific milestones. Details are visible in the user dashboard.
7.3 Payment Processing Payments are securely processed via Stripe. By purchasing, you accept Stripe’s terms and authorize charges.
7.4 Recurring Payments For subscriptions, you authorize recurring charges until cancellation. You may manage this via your dashboard.
7.5 Payment Failures We retry failed payments within 72 hours. Failure to resolve may result in account suspension.
7.6 Optional Pause Members on recurring plans may request a one-time pause of up to 60 days. During this time, no entries or benefits will be accrued.
8. REFUNDS AND CANCELLATIONS
8.1 All giveaway entries are provided as bonus promotional benefits with the purchase of Everest Group Ltd memberships, services, or products at their normal retail value.
No separate purchase of entries is available, and no direct entry fee is charged.
Once a membership or service has been purchased and the associated entries have been allocated, the purchase is non-refundable except where required by Australian Consumer Law.
By purchasing, you acknowledge that you are buying a product or service and not paying for the chance to win a prize. The entry is a promotional bonus only.
8.3 Change of Mind Refunds are not available for change of mind or user error.
9. DISQUALIFICATION POLICY We may disqualify participants for:
a) Fraud, manipulation, or automation;
b) Breach of Terms;
c) Abuse of referral links;
d) Inappropriate conduct;
e) False or misleading submissions. Disqualified users forfeit all entries and prizes. Our decisions are final.
10. TERMINATION OF ACCOUNT 10.1 By Everest Group We may suspend or
terminate Accounts at any time without notice.
10.2 By User Email: everestgroupltd6@gmail.com to request cancellation. Subscriptions are non-refundable and will end at the current billing period.
10.3 Consequences Termination ends all benefits and access. We are not liable for loss resulting from account termination.
11. SPONSORSHIP DISCLOSURE Sponsors are independent. Everest Group is not liable for sponsor products unless stated.
12. PRIVACY We collect data for operational purposes in accordance with Australian Privacy Principles (APPs).
13. AFFILIATE AND REFERRAL TERMS Affiliates must: a) Use approved links; b) Represent Everest ethically; c) Avoid misleading practices. Fraud may result in termination and forfeiture of rewards.
14. INTELLECTUAL PROPERTY All content is our property. Submissions grant us a royalty-free promotional license. Unauthorized use is prohibited.
15. USE OF SITE You agree not to: a) Infringe IP rights; b) Launch attacks or gain unauthorized access; c) Share harmful or illegal content; d) Mislead or impersonate others.
16. LIMITATION OF LIABILITY 17.1 General We are not liable for technical issues, submission errors, or consequential damages.
17.1 Maximum Liability Liability is capped at AUD $100 or the amount paid in the past 12 months.
17.3 Exclusions Your statutory rights under Australian law remain unaffected.
18. INDEMNIFICATION You indemnify us against all claims arising from your use of our Site and Services.
19. DISPUTE RESOLUTION
19.1 Process
Disputes follow this process:
a) Submit a written notice of the dispute to Everest Group Ltd at everestgroupltd6@gmail.com.
b) The parties will meet in good faith within 14 days to attempt resolution.
c) If unresolved, the dispute will proceed to mediation via the Australian Disputes Centre (ADC).
d) If mediation is unsuccessful after 60 days, either party may commence legal proceedings.
Participants who are not satisfied with the outcome of this dispute resolution process may also lodge a complaint with NSW Fair Trading at www.fairtrading.nsw.gov.au.
19.2 Continued Performance Both parties must continue obligations during dispute resolution.
20. GOVERNING LAW These Terms are governed by the laws of New South Wales, Australia.
21. MODIFICATIONS TO TERMS Terms may be updated on our Site. Continued use constitutes acceptance.
22. SEVERABILITY Invalid provisions are removed without affecting remaining Terms.
23. ENTIRE AGREEMENT These Terms and the Privacy Policy form the full agreement between you and Everest Group Ltd.
